Please read these Terms of Service ("Terms") carefully before using the ToyFlag mobile application ("the App") operated by ToyFlag ("we", "us", or "our"). By downloading or using ToyFlag, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ToyFlag, you confirm that you are at least 18 years of age and agree to these Terms. If you do not agree to any part of these Terms, you may not use the App.

2. Description of Service

ToyFlag is a mobile application that uses AI vision technology to help users identify toys by photo and check them against the U.S. Consumer Product Safety Commission (CPSC) recall database. The App provides informational results based on publicly available recall data.

3. Informational Purpose Only

ToyFlag provides information for general reference purposes only. Results are based on the CPSC SaferProducts recall database as of the date of your scan and are subject to the following limitations:

• AI-based toy identification may produce incorrect results. Visual identification is not a substitute for reading the exact model number on the product label.
• The CPSC database may not reflect recalls announced within the last 24–48 hours.
• A "no recall found" result does not guarantee the toy is safe or free of hazards.
• ToyFlag is not liable for identification errors, missed recalls, or decisions made based on App results.

Always verify recall status directly at CPSC.gov before making any safety decision.

4. No Professional Safety Advice

ToyFlag does not provide professional safety, legal, or medical advice. The App is not a substitute for direct consultation with product manufacturers, retailers, or safety authorities. Do not rely solely on ToyFlag when making decisions about a child's safety.

5. Subscription and Free Tier

ToyFlag offers a free tier with limited scans per month and an optional paid subscription ("ToyFlag Pro") with expanded features. Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective billing terms. All payments are non-refundable except where required by applicable law.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the App's source code
• Use automated tools to access or scrape the App
• Misrepresent ToyFlag scan results in a way that could harm others
• Use the App to harass, defame, or harm any person or entity

7. Intellectual Property

All content, branding, design, and code in ToyFlag are owned by ToyFlag and protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works without our express written permission.

8. Third-Party Services

ToyFlag integrates with third-party services including:

• Anthropic Claude API — for AI-based image analysis. Use is subject to Anthropic's Terms of Service.
• CPSC SaferProducts API — a public U.S. government service. No personal data is transmitted.

We are not responsible for the availability, accuracy, or practices of these third-party services.

9. Disclaimer of Warranties

ToyFlag is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or complete. Your use of the App is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ToyFlag and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to reliance on any recall result or identification outcome.

11. Indemnification

You agree to indemnify and hold harmless ToyFlag, its operators, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. The updated date at the top of this page will reflect any changes. Continued use of ToyFlag after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
